INVENTEC PERFORMANCE CHEMICALS USA, a global provider of soldering, cleaning & coating materials for electronic, semiconductor and industrial applications, has filed a lawsuit in U.S. District Court District of Connecticut against Optimal Services LLC, Amtech Manufacturing LLC, Amtech LLC, Amtech Distribution LLC and Mark Miller, an individual, and other unnamed defendants, for unfair competition, false designation of origin and false advertising under Section 43(a) of the Lanham Act, 15 U.S.C. § 1125(a), and for violation of the Connecticut Unfair Trade Practice Act, arising from the unauthorized use of INVENTEC USA’s trademarks.
The complaint concerns a terminated distributor misappropriating not only INVENTEC USA’s AMTECH trademarks and tradenames, but also INVENTEC USA’s entire complex product naming system, duplicating over 50 product names, such as NC-559, RMA-223 and NWS-4200, which names have been used by INVENTEC USA for years. INVENTEC USA has owned all such trademarks and tradenames since 2014 and has been manufacturing and selling its full AMTECH soldering portfolio from its factory located in Deep River, Connecticut
The terminated distributor’s products are deceptively passed off as the AMTECH “Original” products. By filing this lawsuit, INVENTEC USA demonstrates its strong commitment to safeguard the quality, safety, and authenticity of its product and to the protection of the integrity of the market. INVENTEC USA only sells its AMTECH products through its authorized representatives and distributors, a list of which is available on INVENTEC USA’s website. Authentic AMTECH products bear the mention “Inventec Performance Chemicals USA, LLC” on their upper right side.
